CONSULTATION ON HIV/AIDS POLICY AND LEGISLATION REVIEW
The National AIDS Programme will undertake a sub regional analysis of HIV/AIDS policy and legislation around stigma and discrimination in the UK Overseas Territories, through the project entitled “Overseas Territories Project -Taking Action Against HIV and AIDS in the UK OT”.

The objectives of this review are to develop an HIV/AIDS Policy/ Legislation Inventory for the 6 UK OTs and to undertake a detailed policy analysis and legislative review relating to HIV/AIDS in the six (6) UK OT identified.

Areas of focus include HIV related policy and legislation around immigration/employment including mandatory testing of migrant workers; vulnerable populations such as men having sex with men and commercial sex workers (MSM and CSWs); treatment, care and support issues including access to care, third party notification, confidentiality laws and criminalization of knowingly spreading HIV and gender.

Moreover, the project will describe the implications of this policy/legislative climate on HIV/AIDS related stigma and discrimination; to make recommendations for policy refinement/development and for the drafting and enactment of legislation where applicable; to propose pragmatic and effective approaches to bring about necessary changes in policy and legal frameworks; and to make recommendations for institutional and administrative strengthening to better implement proposed policy/legislative reform.

This consultation was held in Providenciales and Grand Turk on April 27 and 28 respectively and facilitated by Mr. Jeff Cumberbatch.

Mr. Cumberbatch is a lawyer by profession, and based on his wealth of experience and his recent work with PANCAP around HIV Policy in the OECS, he was hired to ensure continuity with the PANCAP approach thereby ensuring that the output of this consultancy forms part of a wider regional document. The six-week consultancy throughout the Overseas Territories will consist of desk-based reviews and in-country interviews.

Interviews will be conducted with persons from the public and the private service. The information gleaned will provide valuable strategic information for the development of HIV related policy and programming and will also serve as an additional guidance tool for updating the National Strategic Plan.
